At this stage, the defence must examine both the evidence and the requirements governing an appeal seeking to overturn the acquittal.

In a case handled by our firm, our client had been acquitted at first instance of charges of participation in a criminal association and felony smuggling. The prosecution appealed against the acquittal.

The crucial issue of adequate reasoning

Antonios Ch. Mammis represented our client before the Court of Appeal. He challenged the admissibility of the prosecution’s appeal on the grounds that it did not specifically address the reasoning underpinning the acquittal.

The Court of Appeal upheld the objection. It found that the appeal failed to identify, with the required completeness and clarity, the alleged errors in the first-instance judgment. Selective reliance on evidence and a different assessment of that evidence were insufficient, in this case, to satisfy the requirement for specific and detailed reasoning.

The importance of assessing the evidence as a whole

The first-instance court had considered the evidence as a whole and acquitted our client on the grounds of reasonable doubt. The central question before the Court of Appeal was whether the prosecution’s appeal substantively addressed the specific findings underlying that decision.

The court found that the required rebuttal was lacking. It dismissed the appeal as inadmissible, leaving the first-instance acquittal in force.

Procedural precision in practice

The case highlights the importance of carefully comparing the case file, the judgment and the appeal brought against it. Examining procedural requirements is an essential part of criminal defence.

In this case, analysing the reasons for the acquittal and identifying deficiencies in the prosecution’s appeal formed the basis of the objection upheld by the Court of Appeal.

Specific facts of the case and personal details have been omitted to preserve confidentiality.

Dismissal of a prosecution appeal against an acquittal.
