Mammis represented a client of our firm. The case involved, among other charges, participation in a criminal association and a felony offence under sports legislation.

The importance of specific statutory requirements

The court examined whether the evidence established the specific requirements of the alleged offence. Particular importance attached to the status of the persons involved in the activity in question and its connection with participation in sporting competitions, as required by the applicable provisions.

The majority of the court found that these requirements had not been proved. This finding led to our client’s acquittal of the alleged offence under sports legislation and, consequently, of the charge of participation in a criminal association.

A separate determination for each offence

The judgment addressed each charge separately. Our client was convicted of the distinct offence of unlawful possession of a weapon and received a suspended term of imprisonment and a fine.

This distinction accurately reflects the outcome of the trial: acquittal on the principal charges and a different finding on the separate offence.

Precision in criminal defence

The case highlights the importance of carefully assessing the evidence against each element of a charge. The volume of a case file and the seriousness of the alleged offences cannot replace the need for specific proof.

In criminal defence, examining the facts and precisely interpreting the applicable provisions are closely connected aspects of preparing each case.

Personal details and specific facts of the case have been omitted to preserve confidentiality.

Acquittal on the principal charges in a complex criminal case.
